Successful premiere

Over 480 Bavarian municipalities rely on digital bundled tendering with enPORTAL

The first fully digital bundled tender for electricity supplies, carried out by enPORTAL on behalf of Kommunal-GmbH, a subsidiary of Bayerischer Gemeindetag, was a complete success: over 480 Bavarian municipalities took part, 36 bundled tenders were realised and a total of 18,999 purchase points with a volume of 250 GWh of electricity were put out to tender. The response on the market was enormous: 346 requests to participate from suppliers and 257 bids submitted demonstrate the high attractiveness and efficiency of the digital process. Compared to the high energy prices of previous years, considerable cost reductions were achieved - the peak savings compared to the last tender were up to 78 per cent.

I am responsible for several municipal companies. Do I need a separate contract for each company?

In principle, it is possible to map all points of purchase across several companies in one contract or to conclude individual contracts per unit.

The question of how many contracts you need depends on how you want to invoice the use of enPORTAL connect:

If each unit is to receive its own invoice, you will need a separate contract for each unit.

If you charge the fee for using enPORTAL connect internally, you only need one contract in which all of your units' points of sale are summarised.

If you choose this option, the basic price (see fee sheet) will only be charged once.

If several invoices are required, the basic price is charged once per invoice.

Is it necessary to conclude separate contracts for sector contracting authorities and contracting authorities?

Yes, please conclude separate contracts.

The procedure for sector contracting authorities, according to which tenders are invited, differs from the procedure for public contracting authorities, which is why processing via a service contract is unfortunately not possible.

The service contract usually assumes a term of three years for the energy supply contract. Are shorter terms also possible?

By all means! As part of the procurement concept to be agreed with the Bavarian Association of Municipalities, we are endeavouring to put out tenders for terms of one, two or three years. In our considerations, we take the conditions of the energy market into account to a significant extent.
As soon as the bundled tenders have been prepared, you will be given the opportunity to choose between the options on offer within our platform.

What data does enPORTAL need for procurement?

We need your point of purchase and consumption data for electricity and/or gas. We provide you with a self-explanatory digital import template for this purpose. Please upload the completed import template to the appropriate place on the platform.

In the price calculator, street lighting (SB) and heating consumption points (HS) are not queried separately. How are these consumption points taken into account?

Street lighting consumption points have a standard load profile and are counted as SLP consumption points. In addition, we also count heating consumption points (storage heating and heat pumps) with a temperature-dependent load profile as SLP consumption points.

As part of data collection in enPORTAL connect, this information is requested via an import file.

Where can I find the draft resolution for my committee?

After you have entered your data in the booking tool, you will be sent the service contract and the resolution template by e-mail. Please complete the open points and send all documents back to us together in the event of an order: kommune@enportal.de.

Our municipality/municipality is interested in green electricity, what is the approximate difference to grey electricity?

Just like energy, green electricity certificates are exchange-traded products. The development of exchange prices depends on various factors, including the weather, political conditions and demand. As a result, it is unfortunately not possible to make reliable forecasts for future purchases of either electricity prices or green electricity certificates.

The exchange price level for electricity falls the further into the future you look. However, the certificates for green electricity become more expensive over the same period, i.e. the difference between green electricity and grey electricity tends to increase if you choose a long contract term.

Below is a current indication from the 7th calendar week with a TÜV Süd EE certificate (without new plant quota) and proof of origin:

These are mainly hydropower plants from the north and Austria.

The expansion with a new plant share of approx. 30% would then be a TÜV Süd EE01 certificate, for example. This is then around €0.2/MWh - €0.5/MWh higher.

How does green electricity without a new installations quota differ from green electricity WITH a new installations quota?

Green electricity with a new plant quota refers to energy that comes from plants that are no more than 4 years old. The percentage share from new installations that will be put out to tender in the bundled tenders will be 30 %.

100 % of green electricity without a new plant quota comes from renewable plants that are more than 4 years old, e.g. hydropower plants in Norway or Austria that have been in operation for many years.

How is the municipal discount taken into account and what are the components?

For energy supply contracts generated via our bundled tenders, the municipal discount is settled directly with the grid operator.

When planning your budget, please bear in mind that the basis for calculating the municipal discount has changed:
Previous regulation:

The municipal discount was previously calculated and implemented on the basis of the gross invoice amount including all price components of the low-voltage/pressure grid access invoice.
New regulation according to BGH decision of 05.12.2023 (EnVR 59/21):
The Federal Court of Justice has ruled that the municipal discount may only be granted on the following components:

- Labour, service and base price

Discounts are no longer permitted:

- Licence fees
- Statutory levies
- Charges for conventional metering point operation
- Value added tax on network charges

This decision is based on the current legal opinion of the Federal Network Agency.

Is it necessary to conclude a service contract with enPORTAL in order to participate in the bundled tenders?

Yes, it is necessary to conclude a service contract with enPORTAL. The Bavarian Association of Municipalities has retendered the implementation of the bundled tender for Bavarian municipalities in 2024. The contract for this tender was awarded to enPORTAL GmbH. This means that your new service provider for the 2026 energy tender and subsequent years is enPORTAL.

Our supply contracts run until 31 December 2026. When is the right time to conclude the service contract?

We will of course also carry out bundled tenders for contracts with a delivery start date of 1 January 2027. In consultation with the Bavarian Association of Municipalities, we will make the timing of these tenders dependent on market conditions in particular. It is quite conceivable that we could invite tenders for 2027 as early as the end of 2025.

With this in mind, we recommend that you conclude the service contract now and add your acceptance points to enPORTAL connect without any time pressure so that you are prepared. We will inform all members of the Bayerischer Gemeindetag as soon as tenders are planned for 2027.

Payment is only due once you have actually taken part in a tender, so you are not taking any risk if you conclude the service contract now. We will provide you with the relevant draft resolutions for subsequent tenders in good time.

If you do not yet decide to conclude the service contract at this time, we will of course inform you in good time about further planned bundled tenders, so that you can conclude the service contract at the same time as your desired tender.

What deadline must be observed and by when must the data be submitted to enPORTAL in order to participate in bundled tenders with a supply start date of 1 January 2026?

The last bundle tenders for the start of supply on 1 January 2026 will be launched by mid-September 2025 at the latest. The approval process of your data prior to the announcement also requires approx. 4 weeks, so that in addition to the signed service contract and the authorisations, the data of your consumption points must also be available by mid-August 2025 at the latest. The final allocation is then scheduled for mid-November to ensure a successful change of supplier at the turn of the year.

Experience with the first bundled tenders shows that data collection and reconciliation can take some time. We therefore strongly recommend that you start collecting data using our import file (see download area) regardless of the date of your committee meeting. The information requested in the import file can usually be found in your current supply contract and/or on your supplier's invoices. Your account manager will be happy to clarify any remaining questions with you once you have concluded the service contract.

What does the enPORTAL service cost?

You can calculate your estimated costs easily and immediately using the price calculator in the booking tool. The price sheet will be sent to you by e-mail together with the service contract.

Please note that electricity and gas tenders must always be considered separately and that an invoice is issued for each tender. The basic price of €475 is charged once for each tender.

Where can I find the import template for providing my energy data?

You can find the import template for your electricity and gas collection points on our enPORTAL connect platform in the "Onboarding -> Data collection" tab.

What public procedures are used for tendering?

It is currently planned to issue the tenders as a restricted procedure with a call for competition in accordance with § 16 VgV or § 15 SektVO to be carried out. In the participation application phase, an unlimited number of bidders will be invited to submit a participation application via the European announcement platform TED.

Can I see my energy consumption and contracts at any time?

Yes, you can see your current energy consumption and costs at any time via your personal access to our enPORTAL connect energy platform.

What is the authorisation to obtain data needed for?

With the authorisation, we can contact your existing energy supplier directly and request the load profile and consumption data. Up-to-date consumption data is essential for the successful realisation of energy tenders, as energy suppliers calculate their offers on the basis of this data.

What are the contents of the cooperation agreement between BayGT and enPORTAL?

The cooperation agreement regulates the tasks of enPORTAL (preparation and implementation of tenders) and Kommunal GmbH (in particular coordination of the award concepts, function as tendering body). The service prices (the GmbH receives 10% from these) are also specified.

What is the background to the conclusion of the service agreement until 2030 and the extension option?

The term of the service agreement is identical to the term of the cooperation agreement and thus serves as a framework for the cooperation between the municipality and enPORTAL GmbH. Remuneration is only due if the municipality has participated in a bundled tender.

Is it also possible to shorten/extend the delivery period of three years in Section 1 (3) of the service agreement?

Yes, after analysing your data on the supply points, you will receive a proposal for the tendering concept agreed with the Bavarian Association of Municipalities. If you do not agree with the proposed delivery period, you can deviate from this by informing enPORTAL.

What circumstances would cause Kommunal-GmbH to cancel an invitation to tender?

Kommunal-GmbH will arrange for a tender to be cancelled if no bid is submitted or if an existing bid is deemed uneconomical.

Does a municipality itself have the right to cancel the tender or what option does it have if prices are (again) overpriced?

No, only the Kommunal-GmbH as the body in charge of the procedure decides on the cancellation of tenders.
